Garrity Statement

If an officer is read Miranda and he or she invokes one or more of the Miranda Rights, the agency can request that the Prosecutor's Office or AG's Office  grant "use immunity."  If use immunity is granted, the agency can require the officer to provide a statement, but the statement may not be used in a criminal prosecution.  It may only be used against the officer for departmental charges.  When this occurs, the "Garrity Statement" is first read to the officer.
